OFFICE OF INFORMATION AND DOCUMENTATION MANAGEMENT
Law Number 14 of 2008 concerning Public Information Disclosure (PI Law), enacted on April 30, 2008, and effective from April 30, 2010, was prompted by the unfolding events of reform in Indonesia since 1998, marking a pivotal shift towards good governance, namely the achievement of democratic, transparent, accountable governance and the participation of the public in various processes of public policy formulation.
The PI Law aims to enhance the capacity of Public Bodies to provide information services to the public, while also educating the public in national and state affairs. The enactment of the PI Law reaffirms that public information disclosure is not only a part of universal human rights but also a constitutional right of every citizen, as stated in Article 28F of the 1945 Constitution, which mandates that everyone has the right to communicate, disseminate, and obtain information to develop themselves and their social environment. On the other hand, as mandated by Article 28J of the 1945 Constitution, in addition to the right to public information, the public also has the obligation to comply with various regulations and mechanisms in accessing and using such information.
The transparency and accountability of Public Bodies are increasingly crucial to implement in the era of globalization, where there are no longer any barriers or restrictions limiting public access to information. Therefore, both central and local public bodies must now open themselves to publish information related to policy formulation, programs, and ongoing and completed activities. Similarly, information provided by the public serves as input for public bodies in the policy formulation process that benefits the public, thus creating a two-way communication between the government and the public.
